I brought the correspondence before the Governor, his decision in report to the Colonial Secretary dated 20 March 1847, regarding the required date for a prosecution should it be necessary to institute legal proceedings (a copy of this report is appended). His Excellency being of the opinion that it was highly detrimental to the interests of the Post Office, caused the requisite instructions to be given to the Attorney General, who jointly with the Acting Attorney General commenced Legal proceedings against Captain Cochrane.
On the 2nd June 1847, the case was tried in the Supreme Court here, when the Defendant was fined £100, which was subsequently handed to Mr. Pickering, the late Acting Crown Solicitor, and this concludes the matter.
A letter addressed to the then Colonial Secretary dated 26th August 1848, (paper K:42) detailed all costs (including $115= or £23. 19. 2 Stg fees to the Attorney General) Amounting to $457 or £95.16.2 Sterling.
I beg further to Extract information expectantly from Mr. Campbell's communications to Mr. Parker, regarding a letter from Captain Cochrane dated 10th August (Paper 6:4) certifying that he received his instructions throughout the business exclusively from the Attorney.
I shall not presume to offer any remark upon the peculiarity of this Case.
